General conditions of sale

1 – Premise

The following general conditions of sale, excluding any other agreement, if not agreed in writing, represent the only conditions that RCFISHINGBOAT ® and the buyer accept and to whom they are required to comply; the inclusion of an online order also implies the full acceptance of the following conditions.

2 – Responsibility

RCFISHINGBOAT ® is not responsible for any damage or loss of product, direct and/or indirect, resulting from the sale of goods and services offered in the catalogue published on the site www.rcfishingboat.it, also for delay and/or failure to deliver the product, or for the correspondence of the goods to the specifications published on the site, or for any other fact not attributable directly to RCFISHINGBOAT. Many components such as batteries, electric motors, propellers and models are potentially dangerous for things, animals or people. By purchasing these products, the buyer assumes all liability for risks by accepting that it does not hold any responsibility to manufacturers, distributors and retailers for any accidents and damage to things, people and animals.

 The flight is to be considered dangerous and is strictly forbidden to fly in places with presence of people.

Notes on the safety and use of drones or electronic parts purchased separately

The drones are remote controlled aircraft assisted by control units. Depending on the model they can also have more or less sophisticated control systems via GPS, compass etc.

Like all GPS-controlled devices, they may have problems due to momentary signal loss from satellites. This can generally be caused bysolar storms - geomagnetic fieldsand other radio coverage factors.
There is no answer to any problem caused by these inconveniences as these aircraft are still perfectly pilotable with the radio control in "manual" mode to which you can pass at any time via the appropriate switch on the radio control. Any kind of responsibility will arise.

Before each flight session, it is recommended to check the situation of solar storms through the appropriate websites such as:www.n3kl.orgOrwww.solarham.netEtc.

At the beginning it is recommended to do the proper experience of remote piloting by performing small flight sessions without sending the aircraft too far or too high, although it is true that the drones at the bottom are easily pilotable, it is however necessary that you gradually take in confidence with the aircraft.

It is also necessary to always update the aircraft with the latest firmware version released by the manufacturer.

3 - Technical Information

The technical information on the website: www.rcfishingboat.it are obtained from the information published by the manufacturers of the goods inserted in the catalogue. www.rcfishingboat.it, therefore, reserves the right to modify or adapt the technical and dimensional information of the products of the catalog according to what will be communicated by the producers, even without notice. RCFISHINGBOAT ® is not responsible for any data entry errors and technical specifications relating to products included in the catalogue. In many articles the instructions for use can be in English where not specified.

4 – Orders

Orders can be made via EMAIL or via the Internet (on line). The customer who sends the order via the internet will receive, at the end of the procedure, an email confirming the order with the indication of the relative 'order number'; in the hypothesis that, after sending the order, spent a few minutes does not appear the 'order number', the proposal will be understood as not accepted to any effect of law. RCFISHINGBOAT ® reserves 24/48 hours to check availability of the goods in stock and proceed to its shipment.

5 – Prices

All prices included in the site www.rcfishingboat.it, absolute VAT must be understood unless otherwise stated. Prices can be changed at any time and without notice.

6 - Shipping and Delivery

Shipments, subject to several agreements, will be made by our courier. In this case, and only when the shipping cost with insurance is charged, if agreed between the seller and the buyer or where shown as the service provided by the seller the goods travels with the compensation for damages due to the transport provided that the recipient at the delivery checks tampering and signs the reservation on the delivery note (the recipient will be refunded only when the insurance company recognizes the left).

In the event that the signature of "reserve" does not come from the Customer during the reception of the neck, even if insured the content will not be able to benefit from the regular insurance inserted during shipment by Rcfishingboat.

Shipping costs include packing, insurance (when required) and delivery at the courier or post office, where the item 'package and insurance services included' is mentioned. In case of theft/loss RCFISHINGBOAT ® undertakes to send a new product (only and after the carrier officially informs us of the loss or theft of the goods). In the event that the carrier is in charge, in any way by the customer, RCFISHINGBOAT ® will not be responsible for the loss and/or avary of the product since the delivery of the goods to the carrier.

Shipping costs are NOT REQUIRED, both for the purchase and for the return of goods
Once delivered the goods to the courier RCFISHINGBOAT ® is no longer responsible for delays due to previously described causes and/or other reasons related to logistic causes of the courier. RCFISHINGBOAT ® is not required to inform the recipient about the status of the shipment during its transit, it is the interest of the recipient to contact the transporter to whom RCFISHINGBOAT ® has entrusted the goods to receive information from it. The delivery time ranges from a minimum of 24 to a maximum of 96 hours with valid count excluding public holidays Saturday and Sunday and in all periods of high traffic. The shipment may be delayed if the goods were not available in stock for errors on quantity or if during preparation during the control of the stem there is evidence of defects and is the last available piece. In this case, the customer can cancel the order instantly and be immediately refunded.

The delivery, unless otherwise agreed between the parties, will take place on the ground floor and in the office hours: from 8.30 to 13.30; from 14.00 to 18.00 everyday, not public holidays, from Monday to Friday. With DHL express courier after the second attempt of delivery to the absent recipient or incorrect address, the goods may be redirected to a new contact reported by the Customer with the charge of a new shipping cost. This cost is also due in case the address is the same for the first delivery. The customer can provide at the time of order their telephone contact, for any service communications. If you are not given the possibility to track the recipient in the delivery and delivery phase RCFISHINGBOAT ® is not responsible for the missing addresses and therefore, after the terms established by the carrier, the goods will return to the free sender of deposit expenses plus those of reference; the customer to receive the goods again must correspond to RCFISHINGBOAT ® the shipping cost plus the recovery of deposit expenses and return goods. With Poste Italiane after the second attempt of delivery the goods is kept in free storage for 5 working days; expired the term the goods is returned to the sender with the charge of the shipping cost that will be charged to the Customer.

Any disputes about irregularities and statements issued by the courier at delivery or failure to deliver must be undertaken with the courier himself and with their commercial office, which means that RCFISHINGBOAT ® is not responsible for everything that can declare the courier that relies on the goods. In practice if there are discordant testimonies between courier and recipient regarding uncovered alerts, or absent recipient, RCFISHINGBOAT ® does not take part in the dispute.

7 - Risk and Properties

At the time of packaging, the goods are partially controlled unless the customer's specific request is made and leaves from our warehouse only if it does not appear to have defects or malfunctions.
At the time of delivery of the goods, the Customer must verify the integrity of the packages and the quantitative and qualitative correspondence with what is indicated in the invoice (in case of company or physical person with VAT) contained in a transparent envelope applied within one of the packages, moreover the Customer is required to verify the integrity of the seals affixed with adhesive tape on the packaging. In case of deformity or visible damage of the packaging or tampering the Customer must refuse the goods, the same must be reported on the letter of car accompanied and confirmed within seven days by fax or recommended a.r., a RCFISHINGBOAT. In the event of suspected damage, the Customer must sign the integrity of the goods at the time of delivery. In case the Customer checks after delivery the damage of the goods the same must provide to RCFISHINGBOAT ® the photos of the protective wrapping to witness the status of the packaging at the time of delivery and therefore accepted integro and send within two days the reporting of the anomaly by email, expires every insurance and/or reimbursement from the part of RCFISHINGBOAT ® in cases where the Customer fails to provide the necessary evidence to ascertain the status of the packaging or whether the Customer has been thrown. Even in the presence of integro packaging, the goods must be verified within seven days of receipt.
Any anomalies or manufacturing defects, must be reported in registered letter a.r. Any reporting beyond these terms will not be taken into account. For each statement, the customer assumes full responsibility for what is stated. RCFISHINGBOAT ® where it sends goods with insurance, guarantees compensation for the value of the asset or the return of one of the same characteristics, only in case of loss or theft.

8 – Payments

The goods provided may be paid with: advance bank transfer, Pay post, Paypal, Credit card, check The bank details for transfers will be sent to the customer at the time of order. IBAN: It will be reported at the time of order.

In order to provide you with the payment methods of Klarna, at checkout, we may transfer your personal data to Klarna in the form of contact details and order details, so that Klarna can assess your suitability to its payment methods and customize such payment methods. 9 - Right to cancel orders

The Customer may request the cancellation of the order and RCFISHINGBOAT ® reserves the right to accept the cancellation. The cancellation and acceptance of the same shall take place in writing by registered means within and no more than 5 days. The right to cancel the order is precluded to the Customer in the event that the goods were expressly ordered by RCFISHINGBOAT ® to its supplier and these did not accept, in turn, the cancellation of the order.

10 - Returns Markets

Return of goods to RCFISHINGBOAT ® must be requested in writing, with the indication of the reasons of the request itself, citing the references of the invoices and/or DDT and must be expressly authorized also 'on line'. The return of the goods must be carried out after authorization and assignment, even online, of the 'return number', the goods must be accompanied externally to the original complete packaging together with the return number from the copy of the invoice. The goods to be returned must be in perfect condition, in the original packaging and sent to the free port to our warehouse, citing, on the document, the number of return assigned; the same rule applies also for the return of the goods for hidden damages not detectable to the delivery that have a valid justification, even in this case the Customer will send at his expense the goods at RCFISHINGBOAT ® that below will verify the cause of the damage and, if not due to tampering or incorrect use, will provide for the repair or replacement of the same with shipment in free port. All return costs of the products are expressly borne by the Customer, who, through his own shipper, will send them to the following address RCFISHINGBOAT ® – Via Trasimeno 48 – 20128 Milano (MI). All items must be received in the same terms, provided with the original packaging and any manuals, without any lack. It is understood that the risks of the transport for the return of the items are entirely borne by the Customer, the goods will be controlled below and if without tampering or breakages derived from the return of the transport or from the customer in case the goods has been tampered or arrivals damaged, it will decay every right from the Customer, the goods will be sent to the customer with aggravation of shipping costs for the return.

11 – Guarantees

All products marketed by RCFISHINGBOAT ® are covered by regular manufacturer/importer warranty. RCFISHINGBOAT ® is not responsible for the characteristics indicated for the products on sale since they were supplied by the manufacturers/importers themselves. To make use of the guarantee you must retain the invoice and any original packaging. The warranty lasts 24 months from the date of receipt of the goods.

In the event that the customer needs to use the product guarantee, the same must be returned to the original packaging with the copy of the invoice in its inside with the written back the reason for the return.

Rcfishingboat in case the repaired product is in guarantee, you will be charged with shipping costs in return ensuring the shipped neck.

WARNING:

The packages sent by Rcfishingboat to use insurance must have been sent by the customer in their original box.

Products shipped by the customer to Rcfishingboat in other containers that are not the original one cannot be assured.

Upon arrival of the goods sent back by Rcfishingboat the customer must have the preamura to verify the contents of the goods and to sign reserve in case the product has been damaged, broken, or present other problems, in the absence of the signature reserve the neck even if insured can not be compensated.

12 - Processing of Personal Data

Under the Law 31.12.1996 n. 675, the customer by act that the 'personal data' communicated and/or exchanged, even in the phase of pre-contractual information, will form object of processing pursuant to, for the effects and for the purposes referred to in article 12, paragraph 1, letters b), c), d) and f) of Law no. 675/96 and subsequent modifications and integrations. Moreover, it is understood that the Customer expressly consents to the transfer of personal data pursuant to and for the effects of Article 28 paragraph 4 letter a) of Law No 675/96 and, however, to their communication and dissemination in accordance with and for the effects of Article 20 paragraph 1 letter a) of the aforementioned law.

13 - Right to Retreat

In the event that THE STIPULA OF A CONTRACT OF ACQUISTO takes place FUORI DAI LOCALI COMMERCIALI, the sale in question is to be considered subject to Legislative Decree no. 185 of 22/05/1999, that previews the possibility from the buyer to exercise the right of withdrawal. What excludes:

The right of withdrawal is not applicable on products expressly ordered by RCFISHINGBOAT ® to suppliers upon request of the Customer and therefore not part of the usual assortment of RCFISHINGBOAT ®

How to use:
Make sure you have the following data ready: - original invoice (indicates the order and invoice number); - in case of partial withdrawal, Article code(s); - bank details on which to obtain the transfer (Cod. ABI - CAB - Current account of the invoice holder). * * In the event that the owner of the invoice subject to exercise of Recesso did not have its own bank details, he may provide those of his or her family or acquaintance by making explicit mention of authorization to RCFISHINGBOAT ® to credit the amount on such bank details by e-mail. Subsequently contact the Administrative Office of RCFISHINGBOAT ® to obtain the code of "Reenter Authorized Markets" (RMA). Send an e-mail, a written and signed statement of the will to exercise the right of withdrawal by typing all the data indicated and requested (including also any authorization to credit the amount on bank account registered to third parties). How to return:
After obtaining the number of RMA, carefully pack the materials in order to safeguard the original enclosures and celofans of the products from any damage, written or affixing of labels.

RCFISHINGBOAT, if the above RMA procedure is carried out correctly, it will provide within 30 working days from receipt of the goods to carry out the accreditation to the customer of the amount paid in invoice, excluding shipping costs (art. 5, paragraph 6, Legislative Decree no. 185 of 22/05/1999).

14 – Conditions

The conditions contained in this document may be changed without notice and shall be valid from the date of publication on the website www.rcfishingboat.it. The Customer accepts at the time of purchase all the conditions on this page, so if it does not adhere to such conditions it must give up the acqusto.

15 – Controversies

The Court of Milan is responsible for any dispute under law.

16 – Privacy

We inform you that, pursuant to Legislative Decree 30 June 2003, n.196 - Personal Data Protection Code, Rcfishingboat, based in Via Trasimeno 48, 20128 Milano(MI) is the Data Controller provided by you. The processing of personal data means their collection, registration, organization, conservation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, dissemination, cancellation and destruction, or the combination of two or more of these operations. This data will be processed by RCFISHINGBOAT ® in relation to its requests: - to give execution to the requested service or one or more required operations; - to perform legal obligations;

The processing of data will take place by means of tools suitable to ensure its security and confidentiality and can also be carried out through automated tools to store, manage and transmit data.
